Class Action Filed Against Dean Foods and White Wave Foods for Brain Health Claims

A class action lawsuit has been filed against Dean Foods and White Wave Foods for claiming that their product, DHA Omega-3, supports brain health in children and adults.  The suit, filed in California, alleges “Violation of the Unfair Competition Law, Violation of the Consumers Legal Remedies Act and Breach of Express Warranty.”  The lawsuit alleges that the brain health claims by Dean Foods and White Wave are false, misleading and reasonably likely to deceive the public.  According to the lawsuit, the defendants do not have competent and reliable scientific evidence to support their brain health representations and clinical cause and effect studies have found no causative link between DHA algal oil supplementation and brain health.  Lastly, the suit states that despite the lack of competent and reliable scientific evidence that DHA algal oil supplementation supports brain health, and the overwhelming evidence that it does not, each and every package label repeatedly emphasizes that the DHA-fortified milk supports brain health.  The attorneys at Balkan & Patterson, LLP are experienced in class action litigation and will act to protect consumers against corporate wrongdoers.
