Wrigley Gum Company Settles Class Action Lawsuit for Deceptive Advertising

Members of a national class action lawsuit against chewing gum manufacturer Wm. Wrigley Jr. Co. are now eligible to receive their claims as the $6 million settlement has been approved.

The initial settlement was reached this summer, but approval by a judge was required to finalize the settlement. The lawsuit alleged Wrigley used deceptive advertising claims in marketing the germ-killing properties of its Eclipse-brand gum and mints. Balkan & Patterson represented a number of clients in the lawsuit along with Robbins Geller Rudman & Dowd LLP and Blood Hurst & O’Reardon LLP.

“This is an important settlement for consumers because of the shift in advertising that promotes larger-than-life benefits of using common products – Wrigley is not the only company to do this,” said attorney John Patterson, partner in the law firm of Balkan & Patterson. “Corporations must take responsibility for the products they sell, and representing them in a truthful manner is just one aspect of that responsibility. The hope is that cases like these will set a precedent for other manufacturers who are tempted to mislead consumers.”

Wrigley also agreed to remove labeling on the products that indicates the gums and mints kill germs. Consumers can file a claim against Wrigley until Jan. 24, 2011 to receive a payment.
